Montiel murder trial one year away

CAMP VERDE -- Joseph Montiel was back in court again Monday morning. The accused is looking noticeably thinner than when first arrested for the murder of his estranged wife Jamie Treakle in September of 2012.

The evidence or discovery continues to grow in the murder case in which Montiel's estranged wife was stabbed and her body dumped off the Old Cherry Road near a former mine. Robyn Varcoe, appearing by telephone, told the judge discovery is on-going. Varcoe, one of two women defending Montiel, said the defense team spent Friday visiting the crime scene and has set interviews for mid-November.

Lead prosecutor Dana Owens told the judge she believed the case would need 20 to 25 trial days and Varcoe agreed a month is reasonable.

Judge Michael Bluff noted that, with only three trial days available each week, he believed the case would take a two month period.

Both sides had already agreed that any trial schedule before September 2014 would not be possible due to existing conflicts with their individual schedules.

Bluff set a pre-trial conference for Nov. 12 and insisted that all the attorneys be in court in person along with their trial calendars in order to establish firm dates for the Montiel trial.

Montiel is alleged to have given Jamie a ride when she was released from jail. He then is accused of stabbing her and abandoning the body off the Cherry Creek Road, south of the jail. But Montiel may have left a key piece of evidence behind. His truck was high-centered and stuck when he drove down a side road.

When Jamie's father led a search for her after she disappeared, the team first found the Montiel's truck and then the body was recovered nearby.
